Wendt covernnr
Manager, Environmental Affairs lames S. LOChhead
Peabody Western Coal Company Executive Director
1300 South Yale Street Michael B. Long
Flagstaff, Arizona 86001 Division Dueaor
The current decision due date for the Yoast Mine permit application is March 20, 1995. Since
all of the Division's adequacy concerns with the permit application have yet to be resolved, it
would appear that the Dtvislon will be unable to Issue a declslon on that date.
Rule 2.07.4(2)(a) allows the Division to extend the time for a proposed decision on a new
application for up to sixty days, if the application is unusually complex or controversial or if
stgnlflcant snow cover prevents adequate on-site inspection. The Divlslon believes an extension
of the review period is In order, on the grounds that the application is complex and may be
controversial, since a comprehensive review of the probable hydrologic consequences of the
entire mine plan and a prediction of cumulative hydrologic impacts for Sage Creek and the
Yampa River have yet to be initiated. Therefore, the Division will extend the time for a
proposed decision on the Yoast Mine permit application until May 19, 1995. Should all issues
e resolved prior to that date, the Division will Issue a proposed decision at that time.
If you or your staffs have questions or need additional information, please contact me.
Sincerely,
L~Lc-PJl
Susan L Burgmaie
Environmental Protection Specialist
c: Tom Ehmett, OSM
Rick Holbrook, OSM
John Husband, BLM
Jerry Strahan, BLM
SLd\031395.WP
