SHELTON, Director
~ X876 ~`
Ric nartl D Lamm
Governor
~~
October 3, 1983
Nr. 8111 Wilson
American Fuels, Inc.
P.O. Box 511
Aguilar, Colorado 81020
Re: Stipulatlon Responses, File No. C-031-81
Dear Mr. Nilson:
The Division has completed its review of responses submitted by American
Fuels, Inc. and J.F. Sato and Associates for permit stipulations No. 1
through 14. With the imposition of a few conditions the Division can
determine that all these stipulations have been satisfied. The
conditions are as follows:
1. A reclamation plan and bonding calculations are to be submitted for
sediment pond Z, the new section of haul road, and the coal handiing
facilities.
2. The red dog material from the old refuse pile can be used as
surfacing material for the new section of the haul road. The remaining
material to the pile 1s to be disposed of in the middle, vertically, of
the backfilled pit. It is not to be placed to the bottom of the pit in
order to minimize any Impacts to ground water. It 1s also not to be
placed at the top of the pit since it would inhibit plant reestablishment
on reclaimed areas. Placement of the refuse material in the middle of
the pit should minimize both of these potential impacts.
3. Sixteen inches of freeboard should be installed above the haul road
culvertdraining an area 3.5 acres in size.

You Indicated during our telephone conversation today that these
conditions were reasonable and acceptable. Therefore you are able to
commence any and ali permitted surface mining operations at your will,
unencumbered by stipulation restrictions. The stipulation responses now
become a binding part of the mining permit. Additional responses are due
by the end of the month on stipulation No. 15. This 1s the last
remaining unresolved Stipulatlon on your permit approval at this time.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
