Dept. of Natural Resource <br />Recent conversation with Mr. Eldon Strid, ACZ, Inc., has indicated the <br />request of the Division for certain data regarding other permits and licenses <br />as have been obtained by Terror Creek Company in the construction and installation <br />of the load-out facility at Bowie, Colorado; as well as information concerning <br />water usage at the facility. This letter and the enclosed data are in response <br />to the Division's request. <br />Among data enclosed is a copy of the License Agreement, Contract Number <br />3-07-4A-L0070, between Terror Creek Company and the United States Department of <br />the Interior, Bureau of Reclamation, with concurrance of the Fire Mountain Canal <br />Company as Managing Entity for the Bureau of Reclamation. This license grants <br />Terror Creek the right to cross U.S. easement land along the Fire Mountain Canal <br />by constructing a bridge (box culvert) across the canal. <br />Also enclosed is an executed copy of the Permit For Access to State Highway <br />133 as granted by the State of Colorado, Department of Highways, for the const- <br />ruction of an access approach to said highway. <br />In regard to the adequacy of the water right of Terror Creek Company: As <br />the Division is aware, Terror Creek Company owns the property on which the load- <br />out facility is being constructed. As a part of the purchase, all water rights <br />and conveyence facilities of the Deer Trail Ditch upon the purchased property <br />were conveyed to Terror Creek. <br />The water right consists of 960 shares of Class II stock of the Deer Trail <br />Ditch Company. These shares provide Terror Creek with one-half of 0.25 second <br />feet of water from the Deer Trail Ditch. This right is adjudicated by water <br />decree 4k28, dated June 1, 1983, from the Hubbard Creek drainage of the North <br />Fork of the Gunnison River Drainage Basin. <br />One second foot One cubic foot per second <br />One cubic foot per second = 646,272 gallons per day <br />646,242 gallons per day = 488 gallons per minute <br />One-half of 0.25 second feet = 61 gallons per minute <br /> <br />
