In conferring with Larry, this was reduced to three <br />stipulations. <br />Originally there were two stipulations, one each, for changes to <br />ground and surface water monitoring. Larry thought this was <br />redundant and the two stipulations were combined into Stipulation <br /># 3. <br />During the Division's March inspection of the Loadout certain <br />problems were noted on the ground. These problems resulted from <br />the loadout's having been reactivated for the storage of coal after <br />years of non-use and the current operator's inexperience in <br />operating the Loadout. It was clear at the time that some of these <br />problems would require redesign of the surface water control system <br />and revision of the permit to rectify. The operator agreed to work <br />with the Division on this matter and to submit a revision to the <br />Division soon after permit issuance. <br />A fifth stipulation was added to the permit to account for this. <br />Larry felt that the stipulation implied that the current design was <br />out of compliance and was unworkable if maintained properly. He <br />did not feel that this was the case and so asked that the <br />stipulation be removed (though the revision would still be required <br />to be submitted by Peabody). <br />
