COMMENTS:
Originally there were to have been five stipulations to this
permit. In conferring with Larry, this was reduced to three
stipulations.
Originally there were two stipulations, one each, for changes to
ground and surface water monitoring. Larry thought this was
redundant and the two stipulations were combined into Stipulation
# 3.
During the Division's March inspection of the Loadout certain
problems were noted on the ground. These problems resulted from
the loadout's having been reactivated for the storage of coal after
years of non-use and the current operator's inexperience in
operating the Loadout. It was clear at the time that some of these
problems would require redesign of the surface water control system
and revision of the permit to rectify. The operator agreed to work
with the Division on this matter and to submit a revision to the
Division soon after permit issuance.
A fifth stipulation was added to the permit to account for this.
Larry felt that the stipulation implied that the current design was
out of compliance and was unworkable if maintained properly. He
did not feel that this was the case and so asked that the
stipulation be removed (though the revision would still be required
to be submitted by Peabody).
