II.
Lessee agrees that all alining operations shuZZ b:: conducted in
a careful and workmanlike manner ar:d in accordance with the State and
• Federal regulations and that Lesso,i~, or its designated agents, may
inspect said opera b ons at any tune provided that suc3r inspections do
not interfere with said operations.
III.
This lease shall be effective when both parties hereto have
signed same and shall continue in full force and effect for a period
of three (3) years from and after the date hereof, with an option
for an additional three (3) years lease at the expiration of this
lease with the understandings or agreements between such parties
with respect thereto.
Iv.
Lessee covenants and agrees to pay to the Lessor as tonnage
royalty for each ton of 2,ODOpounds for all mineable, merchantable
• coal mined and sold from said premises as follows:
Three and one-fourth per cent (3~%) of the
Gross Sales Price for all coal mined and
sold from the leased premises. (This tonnage
royalty rate shall be effective as of December
1, 1981. )
Royalties shall be ascertained from weights at Railhead on
certified scales and shall be paid by Lessee to Fred L. Jackson,
Attorney at Law, 500 Franklin Street, Beaumont, Texas = 77701, as
designated agent for Lessor, and aZZ payments shall be made on or
before ten (10) days after receipt of payment by the Lessee from
purchasers of the coal mined under this Lease.
