Maxim does <br />not predict encountering significant ground water. Maxim's report (Additional Stability Analyses) <br />dated January 7, 1997, addresses the steps which will be taken if ground water is encountered <br />which includes the use of a face drain or if necessary additional drainage of the slope. <br />Geotechnical Laboratory Testing, Proposed Gob Pile <br />(Memo #2) <br />The conclusion of this memo is "Until the material shear strength parameters used in the analysis <br />can be successfully verified, the Division will be unable to approve construction of the proposed <br />coal refuse pile at the Bowie No. 2 Mine". <br />BRL and WESTEC contend the stability analysis on the proposed coal refuse pile is valid. <br />Colorado Registered Professional Engineer Allan J. Breitenbach, (#15247) certified the design of <br />the refuse pile as being prepared in accordance with generally accepted professional engineering <br />principles and practice. The certification of the report and the fact the report was prepared by <br />appropriately qualified professionals provides BRL with confidence the coal refuse pile will be <br />stable as designed. <br />Not withstanding the above, BRL has directed WESTEC to mobilize a drill rig to obtain <br />additional samples of the Mancos Shale to verify the strength parameters used in the stability <br />analysis.
