The memos were from Jim <br />Pendleton to Dave Berry. Following aze BRL's responses to the memos: <br />Additional Stability Analyses, Proposed Portal Road Cuts and Topsoil Pile <br />(Memo #1) <br />This memo has a concern that the "J. E. Stover and Associates' summary statement appeazs to <br />selectively commit BRL to implementing only a specific selection of Maxim's geotechnical <br />recommendations. This was not the intent of the summary statement. The summary statement <br />has been revised to clarify this issue. <br />The memo directs BRL to have qualified geotechnical observers in attendance whenever <br />construction is occumng and to maintain thorough daily construction log sheets which would be <br />submitted to the DMG via facsimile weekly. Further, BRL is directed to communicate any cut <br />slope, fill embankment, or drainage facility design modification or mitigative implementation to <br />the DMG prior to its implementation. <br />BRL will have a representative on site whenever construction is occurring. However, BRL will <br />not necessarily have a qualified geotechnical observer on site whenever construction is occurring. <br />The qualified geotechnical observer will visit the site on a schedule deemed appropriate by BRL. <br />BRL's on site representative will be informed of conditions that may warrant an unscheduled visit <br />by the qualified geotechnical observer. The above referenced introduction states in part: "BRL <br />will have a qualified person available to observe the construction of the proposed cut and fill <br />slopes to identify conditions which may be detrimental to stability of a slope (ground water, soft <br />or loose soils, or conditions not encountered in the Maxim borings). BRL further commits to the <br />proper engineering and remediation of conditions which are determined to be detrimental to slope <br />
