This document <br />incorporates existing environmental baseline data, planned operations, <br />and reclamation plans of the loadout facility and supporting <br />information. <br />Based on earlier correspondence with the Colorado Mined Land <br />• Reclamation Division ("Division"), and prior to determination of <br />requirements for a formal application, the Terror Creek Company has <br />already begun construction activities. In fact, all site work is <br />virtually complete. The attached permit application reviews the <br />construction techniques and various plans which have been put into <br />effect to protect the surface and groundwater, and soil resources of <br />the area. The final construction of the sedimentation control <br />structure, diversion ditches, and installation of a berm along the <br />outside edge of the pad area has been completed. <br />Due to the extremely tight schedule which the Terror Creek Company is <br />operating on and the various misunderstandings with regard to the <br />requirement of a formal permit application, the Terror Creek Company <br />judiciously requests that this permit application be reviewed as <br />quickly as possible. We want to maintain open lines of communication <br />between the Terror Creek Company and the Division to ensure that any <br />concerns that the Division may have are carefully and quickly answered <br />so that the permitting process can proceed as smoothly as possible. <br />If you have any questions, please feel free to contact me or Eldon D. <br />Strid of ACZ INC. <br />EDS/sk <br />cc: Eldon D.
