~~ <br />Mr. Paul Baker - 2 - December 10, 1992 <br />The environmental conditions at the Coal Gulch Mine remain unchanged, and need to be <br />remediated to the near future. Therefore, the Division needs an indication from <br />Pennsylvania West Coal Company as to when it will make the application complete by <br />addressing the deficiencies noted in our incompleteness notifications. I would also <br />like to know the anticipated production and construction schedules and dates in <br />order to have an idea as to when activities at the mine will commence and the scope <br />of these activities. This will allow the Division the flexibility to remediate next <br />spring any environmental or health and safety problems which will not be addressed <br />by the anticipated Pennsylvania West operations. <br />The Division feels that the Coal Gulch site in its present condition is a potential <br />hazard to the surrounding environment and human health and safety. Unless an <br />aggressive permitting schedule is adhered to by Pennsylvania West, the Division will <br />fulfill its statutory obligation to remedy these problems by initiating reclamation <br />operations at the Coal Gulch Mine in the spring of 1993. <br />Please contact me if you have questions or comments. <br />Sincereiy, <br />Steven G.
