Martinez - 2 - June 24, 1991 <br />Please also understand the Succession of Operator approval was delayed due to <br />the applicant's failure to provide all necessary documents by the March 1, <br />1991 deadline. As of March 1, 1991, additional documentation was needed <br />regarding the Letter of Credit from the Trial Bank, a necessary letter from <br />the Key Bank (Price, Utah) was still lacking, and specific riders to the <br />insurance policy covering the site were absent. Because of these problems, <br />the Division worked with Mr. Swimmer and L & L Energy to extend the March 1, <br />1991 deadline to allow resolution of these problems. All necessary documents <br />were finally received on March 7, 1991 at which time the Division promptly <br />processed the Succession of Operator. <br />As previously noticed, on June 26-27, 1991 the Colorado Mined Land Reclamation <br />Board will conduct a Formal Public Hearing to determine the amount of civil <br />penalty to be levied pursuant to the above-referenced Notice of Violation. <br />Additionally, the Board will determine whether the permit should be revoked <br />and the reclamation bond forfeited.
