Asa follow-up to our February 3rd telephone conversation, it is your
intention to complete the necessary permitting of this site pursuant to
CRS 34-33-101 et. seq. and the promulgated Rules and Regulations. To this
end, you shoulcT-ccommence publication of the appropriate legal notice in the
Du~rango~ Herald, pursuant to Rule 2.07.3(2). Enclosed is the suggested format
oar t~i1"s p- ubTication, Please ensure that this public notice is published once
weekly for four weeks with correct information.
While you are publishing the public notice, the Division will complete a
detailed adequacy review of this application to ensure it complies with all
applicable portions of the Act; and begin preparation of our findings. Please
be aware that the October 12, 1984, letter sent to Fidel Lobato was only a
relp iminary adequacy review. The "preliminary" adequacy review only
1 en~t1 ie~substantial omissions within the permit application; the "detailed"
adequacy review will specifically address permitting concerns as they relate
to Rules 2 and 4. These concerns will be put into a letter to be sent
directly to you as soon as we complete the review.
The Division wi]1 assist you in obtaining a permit from this agency as much as
feasibly possible. Some of the required information may be obtained from
National King Coal's permit application. Your prompt and thorough replies to
our questions will great]y speed review.
To assist us in completing our detailed adequacy review, it will be necessary
for you to submit two copies of the complete application to our office as
addressed in the October 12, 1984, letter. Please forward these copies to my
attention.
