Burgmaier: ._
We have completed our review of Seneca Coal Company's Yoaet Mine Permit
Application Package (PAP). The PAP was reviewed for the following:
Compliance with special lease stipulations and agency regulations.
- No compliance problems were identified with the special lease
stipulations.
(a) Cultural resource inventories are included and proper on-going
consultation documented.
(b) Paleontological resources are not addressed in the mine plan
specifically, however, the federal lease stipulation adequately
~ ~ identifies meaeuree to be taken in case of discovery of fossils
'~ during operations.
(c) No surface disturbance is proposed in the area identified on the
lease as Fragile Soils.
Analysis of lands unsuitable for surface mining and reclamation pursuant to 43
CFR 3461.
- Through our land use planning process, none of the lands contained in
the affected federal lease COC088199 have had unsuitability applied.
Unsuitability criteria were applied to the lands added to lease
COC0114093 prior to lease modification. Pursuant to 43 CFA 3461.3-2 we
do not apply unsuitability criteria to leased lands. No unleaeed
federal lands are proposed to be affected by mining within the mine
permit area.
Conflicts between poet-mining land uses and existing BLM land management plane
and policies.
- Although this mining operation will not have significant overall impacts
to wildlife habitat, we recommend that the latest techniques in woody
plant species establishment be used in an effort to replace the
disturbed aspen and mountain shrub communities that are essential to
many species of wildlife, particularly neotropical migratory birds. No
other conflicts were identified.
Adewacv of meaeuree to protect federal resources not covered by the rights
granted by the federal coal leases.
- No problems were identified under this issue.
