Section 2.03.4(3)(d) requires the employer identification <br />number (EIN) for each name that owns or controls the applicant. <br />Please submit the appropriate EIN to comply with this regulation. <br />4. In the submitted permit application, Hayden Gulch <br />Terminal stated that the MSHA identification number was pending. <br />Under Section 2.03.4(8) please submit the MSHA identification <br />number to the Division when it has been issued to the HG Loadout <br />mine. <br />Section 2.03.5 Compliance Information <br />510c letters were sent out to other state regulatory agencies <br />who have issued permits and or notices of violation to Peabody Coal <br />Company. <br />Section 2.05.3(3) Mine Facilities <br />1. Please state whether any facilities will be modified or <br />reconstructed for use in the Hayden Gulch Loadout Facility. Under <br />rule 2.05(3)(b)(ii) a compliance plan must be submitted to the <br />Division to include designs, construction schedule, monitoring <br />provisions, and public health and safety during the period of <br />modification or reconstruction. <br />2. Describe the measures to be taken to protect the inlet <br />end of a ditch relief culvert for approval by the Division under <br />4.03.1(4)(e)(vi)(E) or 4.03.2(4)(e)(v)(E). <br />3. Rule 2.05.3(c)(v) states that measures must be taken to <br />ensure public safety where mining activities are within 100 feet of <br />the public road. Please define what measures will be used to <br />ensure that the interests of the public and landowners affected are <br />protected due to the proximity of mining activities. <br />
