• wells as a part of the operational hydrologic monitoring plan
for the Yoast Mine. SCC has revised Table 15-8 to include
both the Trout Creek Sandstone production well (YTC32) and
Trout Creek Sandstone observation well (YTC33), and to
identify the frequencies proposed for monitoring at both
wells. Table 15-3 has also been modified to include these two
proposed wells.
Monitoring of these wells is contingent upon BCC's decision
whether to construct the mine facilities as proposed in the
Yoast PAP. If SCC decides not to construct the mine
facilities, SCC commits to performing an evaluation of the
potential for mining impacts to the Trout Creek Sandstone in
order to justify not monitoring this aquifer. This evaluation
will then be submitted to the CDMG in the form of a technical
revision.
50. SCC has not proposed discontinuing monitoring of the Wolf
Creek Underburden Well YWCU31 in Tab 15, either on Page 21 or
in Table 15-8. This issue was clarified during the February
1, 1995 meeting held in Denver between SCC and CDMG personnel.
Review of Table 15-8 has resulted in SCC modifying the table
to show monitoring frequencies for water quality at Wolf Creek
Coal Well YWC31.

• 51. SCC has initiated the process of securing the water rights
necessary for using water from sedimentation ponds (010 and
012) for dust suppression. The process includes submitting
the recently completed report titled "Water Rights
Investigation and Plan for Augmentation for the Yoast Mine"
(the Plan) to the District Court for Water District 57. The
submittal will trigger BCC's application for water rights at
both sedimentation ponds via transfer of existing SCC water
rights in the Sage Creek Basin. Three copies of the Plan are
included with this response for insertion in Attachment 16-1,
Tab 16, Volume VIII of the Yoast PAP.
52. Three copies of the "Water Rights Investigation and Plan for
Augmentation for the Yoast Mine" are included with this
response package for inserting into Attachment 16-1, Tab 16,
Volume VIII of the Yoast PAP.

backfilled with the spoil being excavated. A review of Tables
