Ga~i. of ~ilE2.','~i }?r,~urye <br />Due to a misunderstanding of the regulations and previous conversations with you, <br />BLUE FLAME COAL MINE has realized that there are actually fifty-three (53) acres to be <br />involved in the permit area. 'T`here have always been fifty-three (53) acres involved <br />in the project, but due to our misunderstanding we never mentioned the fact that the <br />additional twelve (12) acres would be included in the permit area. Sorry Peter, that <br />was my fault. <br />2.03.4. I have revised Map 1 to show the parcels owned by private parties. <br />Notice that a gentleman named JACK WILTSE has been found to own property in the af- <br />fected area. Previous to my working on BLUE FLAME COAL MINE'S permit application, <br />CARWIN R. BLEIDT & ASSOCIATES retained a lawyer to do a title search in which he found <br />that only the HUNTING'IC)NS owned land in the affected area. I have realized that this <br />title search did not include twn (2) of the other legal owners of the surface, because <br />I have identified WILTSE as a surface owner, I have taken the necessary steps to contact <br />him by certified mail, as to his use of the surface after reclamation of BLUE FLAME COAL <br />MINE. I will send the additional copies of a certified mail receipt and the letter to <br />as soon as Z receive the receipt. <br />2,04.7 If and when sediment fran the sediment pond is to be removed it will be <br />tested to determine its viability as topsoil material. If it is good enough to be <br />used as topsoil it will be added to the topsoil stockpile located on Map 1. If it <br />tests out to besub-standard it will be added to the sediment stockpile on the mine <br />bench. <br />2.05.4 REVEGITATION SUCCESS CRITERIA: Please note that "B" has been amended to <br />raed as follows: The standard for herbacious productivity is 500 pounds per acre of <br />dry biomass measured through the use of the harvest method via one (1) square meter <br />quadrants . <br />4.20 SUBSIDENCE: <br />(6) Be advised that this sentence has been revised to read as follows: BLUE <br />FLAME COAL MINE ccmnits to monitoring on a quarterly basis throughout the life of the <br />mine and filing that information with the MIRED LAND RECLAMATION DIVISION. <br />Thank you for your attention to this matter. <br />S' exel //n, <br />• "~I~ <br />
