7. Page 7, 2nd paragraph,insertion of "adequate amount" in place of "four <br />feet..." <br />S. Page 7, 3rd parapraph, insertion of"optimum"in place of "optional ..." <br />9. Page 9, 1st paragraph, rewording of the paragraph to include,"the finding <br />of 2.07.6(2) is not required for underground mining." <br />10. Page 9, 3rd paragraph, the violations are not abated, therefore, Powderhorn <br />Coal Co~pany has two (2) outstanding violations. Mr. Banta said that a dis- <br />cussion of allegations will be made and the wording would include "alleged". <br />11. Page 10, 4th paragraph, "direct surface distrubance..." will be clarified. <br />12. Page 10, 5th paragraph, "indirect impact..." will be clarified. <br />13. Page 10, 5th paragraph, "eligible site..." will be reworded to read "eligible <br />for listing on the National Register". <br />14. Page 10, Stipulation No. 1, Fred Banta indicated that because the stipulation <br />was poorly worded, the stipulation would be rewritten. <br />15. Page 12, 2nd paragraph, CMLRD will restructure this paragraph to reflect com- <br />pletion of the sedimentation control project. <br />16. Page 12, 3rd paragraph, James Herron indicated that he had no problems with <br />rewording "The outflow below the spillway is to be riprapped to control <br />erosion.", to "The outflow below the spillway is to be riprapped where necessary <br />to control erosion." <br />17. Page 13, 7th paragraph, is changed to read, "The reclamation plan will call for <br />re-establishment of riparian vegetation if disturbed." <br />1H. Page 14, 1st, 2nd, 3rd and 4th paragraphs, the word "aquifer" needs to be <br />changed to "water bearing stratum" as it is mentioned in the 2nd paragraph. <br />19. Page 14, 6th paragraph, Fred Banta indicated that consumption is the proper <br />term for the water that has been removed from the mines via ventilation, coal <br />transport and dewatering. <br />20. Page 14, 7th paragraph, the wording will be changed. Powderhorn Coal Company <br />will have to demonstrate that water is available or at least the means are <br />available to replace water in the mine. Fred Banta said that the words water- <br />rights would be rewritten (stricken?). <br />21. Page 15, 3rd paragraph, the first sentence will be deleted. Fred Banta said <br />that CMLRD could insert a sentence that "this is currently occuring but will <br />be revised as new information becomes available as a result of NPDES require- <br />ments." The second sentence should read "of less than 0.1~." CMLRD will check <br />this. <br />
