<br />RECLAMATION SUMt•tARY OP <br />FISH CREEY. SEEDING <br />On the 14th day of September, 1972, Energy Fuels <br />Corporation made application to the Colorado Department of <br />Natural Resources, attention of htr. Don 1!aske, for a permit <br />to operate an open-cut strip mine to be Y,nown as "Energy \o. <br />2" in Section 25, Totanship 5 North, Range 87 West of t}te 6th <br />P.M. The same was approved on September 15th, 1972 as <br />Permit No. 32 as issued by the Colorado Department of <br />Natural Resources. T:tis permit was to cover the period of <br />July 1, 1972 to June 30, 1973. Issuance of subsequent <br />permit No. 49 covered this area through June 30, 1974. Bond <br />was posted on the initial disturbance at the Energy No. 2 <br />Mine, but, with the consolidation of all Energy Fuels' <br />permits and bonding on August 16, 1976, this area was <br />adequately covered by the floating bond posted by Energy <br />Fuels under a Life of the fiine Permit ido. 76-16. <br />Actual mining began in September of 1972, shortly after <br />approval of htine Permit No. 32. Initial mining operations <br />involved the stripping of topsoil with two Terex'TS-19 twin- <br />bowl scrapers followed by the stripping of the overburden <br />with two Caterpillar D-9 bulldozers. <br />A number of reclamation performance standards were <br />placed upon Energy Fuels to assure that the land was reclaimed <br />to a useful and productive state. The initial concern fo= <br />reclamation was set forth prior to the.applicati~n made tc <br />obtain a state mining permit. In a letter dated November 3, <br />1972 Energy Fuels informed Mr. Donald Haske, Chief Inspec`_or, <br />State Coal Mine Inspection, that all affected lands would be <br />seeded and returned to their owner for grazing purposes, <br />This letter made reference to a lease agreement dated <br />September 10, 1972 with the surface owner, Bogle Farms, Inc. <br />The entire text of that lease agreement concerning the <br />reclamation standards was found in item 6 and read as <br />follows: <br />6. Lessee agYees that it shall, at its own sole <br />cost and expense, restore the surface of the land <br />mined, and reclaim •t he topsoil thereof and shall seed <br />the same with the type of grass which shall be selected <br />by the Lessor, and Lessee shall: <br />(1) Segregate all topsoil from other over- <br />burden; <br />(2) Grade the entire affected area into a <br />gently rolling topography; <br />(3) Replace the topsoil over the other <br />overburden. <br />
