The Federal and State regulations are given below. <br />Federal regulation B16.106, Regrading or Stabilizing Rills and Gullies <br />When rills or gullies deeper than 9 inches form in areas that have <br />been regraded and topsoiled, the rills and gullies shall be filled, <br />graded, or otherwise stabilized and the area reseeded or replanted <br />according to Section 816.11-816.117. The regulatory authority <br />shall specify that rills or gullies or lesser size be stabilized <br />and the area reseeded or replanted if the rills or gullies are <br />disruptive to the approved post-mining land use or may result in <br />additional erosion and sedimentation. <br />State regulation 4.14.6 Regrading or Stabilizing Rills and Gullies <br />(1) When tilling and gullying deeper than 9 inches occurs in areas <br />that have been regraded and topsoiled, the rills and gullies shall <br />be filled, graded or otherwise stabilized and the area reseeded or <br />replanted in accordance with 4.15. The method for reclamation of <br />areas of excessive tilling and gullying shall be in a manner <br />approved by the Division giving appropriate Consideration to any <br />resulting disturbance to previously revegetated areas, and in all <br />cases, to the stabilization of the gully head. <br />(2) In cases where the permittee demonstrates to the satisfaction <br />of the Division that tilling and gullying is not excessive and is <br />consistent with the approved post-mining land use, then such <br />reclamation will not be required. Such demonstration shall at a <br />minimum, give consideration to natural geomorphic processes in <br />comparison to baseline conditions or the erosional characteristics <br />of similar undisturbed areas under good management practices.
