Facilities have not yet been con- <br />structed at discharge point 007 because there has been an open pit at this <br />location which detained all mine drainage. At the present time there ie no <br />discharge at outfall 007. Verification of the construction of facilities at <br />this location will be submitted at least ninety (90) days prior to diacharge~ <br />from active mining areas into vatere of the State. <br />This letter is written in accordance with certain provisions of NPDES <br />Permit No. CO-0027154. Specifically, in accordance with Part I, Section A: <br />Effluent Limitations - Containment Requirements (Coal Mines Only), within, 90 <br />days ~of the effective permit date, the permitee is required to submit veri- <br />fication that facilities have been designed, constructed and maintained to <br />contain or treat the volume of water from active mining areas, preparation <br />plants and associated areas which would result from a 10-year, 24-hour pre- <br />cipitation event. Enclosed are certifications from Leonard Rice Consulting <br />Water Engineers. Inc.. CTL Thompson. Inc., and ACZ, Inc., endorsed by registered <br />progeseional engineers. These certifications are submitted to verify that design <br />criteria have been met for sedimentation goad facilities and that facilities <br />have been constructed and maintained to treat discharge from active mining areas <br />At the present time there ie no mining or associated activity being con- <br />ducted at Energy Mine No. 3. and the Colorado Mined Land Reclamation Division is P9/1 <br />reviewing the design of operational .and treatment facilities for this area: ~i/~ ~x <br />Consequently, it is not possible to provide the facility design information and `~8~ <br />verification required by Part I, Section A for Energy Mine No. 3. At the pre- <br />sent time there is no discharge from Energy Mine No. 3. the facility design <br />information and verification required by this provision will be submitted at <br />least ninety (90) days prior to discharge from active mining areas at Energy <br />Mine No. 3 into vatere of the State. <br />In accordance with Part III, Section A of the permit, a map showing present <br />discharge points is enclosed. Notice that two new discharge points, 016 and 017 <br />Exhibit 1 <br />
