,,
Mr. Fred Matter, P.E.
October 22, 1982
Page 2
The NOV sets forth two types of alleged violations: failure
to verify design and construction of sedimentation ponds, and
excursions regarding effluent limitations. Each of these types
of alleged violations will be discussed separately.
1. Verification of Design and Construction of Sedimentation
Ponds.
The NOV is unclear regarding the particular ponds for which
the Division has insufficient information regarding construction
and verification. At the October 12 meeting, you and Pat stated
you were not sure which ponds were or were not certified.
CYCC's records show that the Division has approved the de-
sign of 16 sedimentation ponds (Ponds A through T, inclusive).
However, the Division has apparently received information on
construction and maintenance of only eight ponds. These ponds
are as follows:
Discharge Point
Discharge Point
Discharge Point
Discharge Point
Discharge Point
Discharge Point
Discharge Point
Discharge Point
#1
#2
#3
#4
#5
#6
#8
#9
(Corresponds
(Corresponds
(Corresponds
(Corresponds
(Corresponds
(Corresponds
(Corresponds
(Corresponds
to CYCC
to CYCC
to CYCC
to CYCC
to CYCC
to CYCC
to CYCC
to CYCC
Eckman Pond A)
Mine 1 Pond T)
Mine 1 Pond B)
Mine 1 Pond C)
Mine 1 Pond DJ
Mine 1 Pond E)
Mine 1 Pond GJ
Mine 1 Pond HJ
See attached copies of letters dated July 16, 1981, October 2,
1981 (regarding discharge points 1, 2, 4, 5, 6, 8, and 9) and
letter dated March 24, 1982 (regarding discharge point 3). These
letters are attached hereto as Exhibits 1, 2, and 3, re~pec-
tively.
The problems therefore appear to relate to discharge points
7 and 10 through 17, inclusive. If your records differ, please
so notify me.
Construction of ponds at discharge points 16 and 17 (cor-
responding to CYCC Mine 1 Ponds M and K respectively), has been
virtually completed. The pond at discharge point 7 (CYCC Mine 1
