Shelton <br />Director <br />and Access Road Areas, <br />I have reviewed the above-referenced report, prepared for Bear Coal Company <br />by Rocky Mountain Geotechnical, Inc, This report is a final version of the <br />draft document which I reviewed in preparing draft finding dc>;uments for <br />your use regarding the Bear No. 3 mine. The final report conforms with the <br />technical findings of the preliminary draft version. <br />Because. recent events have delayed your issuance of the findings document and <br />the original situation has been altered by the submission of the acceptable <br />final report, the following changes in your findings document are now <br />appropriate: <br />(I) Page 73, paragraph I, sentence 3 following stipulation No. 7 should be <br />amended to read; "The applicant has submitted a pre~trrsncrg;-Bat-date#~ed7-draft <br />report of a geotechnical investigation and stability analysis of the proposed <br />portal access road and portal facilities, prepared by Rocky Mountain Geotechnical, <br />Inc." <br />(2) Page 74, stipulation No. 8 should be amended to read; <br />"THE DIVISION DIRECTS BEAR COAL COPIPANY TO SUBMIT A DETAILED ENGINEERING <br />PLACI FOR THE PORTAL ACCESS ROAD AND PORTAL FACILITIES AT THE BEAR NO. <br />3 bfZNE, FOR REVIEW AND APPROVAL BY THE DIVISION, NO LATER THAN 30 DAYS <br />FOLLOWING APPROVAL OF THE PERMANENT PROGRAhJ PERMIT. THIS DETAILED <br />ENGINEERING PLAN SHALL INCLUDE ROAD AND PORTAL CROSS-SECTIONS, ROAD AND <br />PORTAL PLAN AND GRADE DESIGN DRAWINGS, AND DETAILED ENGINEERING <br />DESIGN DRAT/INGS FOR ALL $ETAZNING STRUCTUP.ES AND DRAINAGE FACILITIES. <br />NO ADDITIONAL DISTURBANCE SHALL OCCUR ZN TF1E AREA OF THE PORTAL ACCF-SS <br />ROAD OR PORTAL FACILITIES UNTIL THESE DETAILED ENGINEERING PLANS HAVE <br />BEEN REVIEWED AND APFROVED BY THE DIVISION. <br />/mt <br />cc: Fred Banta <br />David Shelton <br />
