Mr. Fred Banta <br />Mr. Floyd Johnson <br />March 24, 1982 <br />Page Four <br />The following steps must be completed once the decision document <br />arrives in Washington: <br />• Solicitor's office must review the legal aspects of the <br />permit revision and decision document and concur that no <br />legal problems exist. <br />• The environmental assessment, the findings of no significant <br />impact, the independent review of each environmental <br />discipline, and the stipulations of the Division must be <br />reviewed and approved by the OSM Environmental Impact Group <br />headed by Mr. Frank Anderson. <br />• Mr. James R. Harris, Director of OSM, will review Denver and <br />Washington recommendations and sign off on the package. He <br />will recommend approval of the plan revision to the <br />Assistant Secretary of the Interior, Energy and Minerals, <br />• The Assistant Secretary of the Interior, Energy and Minerals <br />will approve the permit revision. <br />• The approval will be forwarded back to the Denver office <br />with subsequent approval given to Bear Coal Company. <br />Once the approval from Washington, D.C. and Denver is made to Bear <br />Coal Company, the Denver OSM office must publish a notice of <br />availability of the decision document and the plan. This decision <br />must be published within 10 days of the approval of the permit <br />revision in a newspaper of local circulation. OSM must also contact <br />local, state or other interested parties as part of the notice of <br />approval and plan availability. <br />Once the approval is granted by the Assistant Secretary of the <br />Interior, Energy and Minerals, then the Bear Coal Company will be able <br />to initiate facility relocation and begin mining. The target date is <br />tdonday, May 10, 1982. <br />Division Aooroval Timetable <br />The following is the time frame proposed by Mr. Fred Banta concerning <br />the final assessment and approval of the Bear Coal Company permit <br />revision: <br />Meeting OSM to discuss stipulations <br />to be given to Bear Coal Company <br />Finalization of findings document <br />by Division staff with input from <br />OSM <br />Notice of proposed approval given <br />North Fork Times in Paonia, <br />Colorado <br />Friday, March 26, 1982 <br />Friday, April 2, 1982 <br />Monday, April 5, 1982 <br />
