;., <br /> <br />The USFS identified a need for monitoring of water sources (springs and <br />stock ponds, etc.) above areas to be retreat mined during the grazing <br />season. The monitoring would be required monthly unless the District <br />Ranger determines a different Frequency is necessary. This commitment <br />was made in the permit application and therefore, a special condition <br />was not needed in the State permit or mining plan approval. <br />Additional mitigative stipulations are included in the Colorado D1LRD <br />renewed permit. <br />Two special conditions of the existing mining plan approval are no <br />longer necessary. Special Condition 5 required the addition of the <br />United States of America to the bond as a co-obligee. This has been <br />done. Special Condition 6 stated that the mining plan approval does not <br />affect the outcome of the (then current) challenge to the Federal permit <br />before the Interior Board of Lands Appeal. A decision on the merits of <br />the case was issued by the IBLA on September 27, 1985, and on the issue <br />of relief on November 18, 1986. No additional conditions were required <br />by those decisions. <br />The information in the PAP, as well as other information identified in <br />the decision document included with this memorandum and made available <br />to the applicant, has been reviewed by Colorado MLRD staff in <br />coordination with the 05h9tE Project Leader.
