<br /> <br />~. COLOR OF IMPROVEMENTS <br />1. The developers of the mine shall submit a color plan for all buildings <br />for approval by the Board of County Commissioners. The developers shall consult <br />with homeowners in Riverbend Subdivision and landowners located north of the <br />Colozado River and within a one (1) mile of the mine site after consultation <br />with such owners, shall provide plywood mock-ups demonstrating four (4) colors <br />for evaluation not later than October 15, 1985. The mock-ups shall be eight <br />feet by eight feet (B' x 8'). The developers and owners shall select the most <br />appropriate color(s) and shall submit same for final approval by the Hoard of <br />County Commissioners. The color scheme approved shall apply to the walls and <br />roofs of improvements constructed at the mine site. <br />D. LIGHTING STANDARDS <br />L. The developers of the mine shall meet all applicable government <br />regulations and standards for the lighting of the project and shall include such <br />additional lighting as may be prudent for safe working conditions. Subject to <br />the foregoing, all lighting shall be installed so as to minimize off-site <br />impacts to the extent reasonably feasible. By way of example and not as a <br />limitation, lights illuminating areas of the project shall be directed downward <br />and toward the surface of the project by appropriate reflectors. In addition, <br />the developers of the mine shall not illuminate the mine or its facilities with <br />any cosmetic or dramatic lighting. No lighting shall be required on County Road <br />335. <br />v E. POWDER MAGAZINES <br />1. To the extent permissible under regulations of the governmental <br />agencies having jurisdiction, the developers shall locate the Powder Magazines <br />at minimum separation distances as provided by such regulations and shall <br />relocate the westerly Powder Magazine to a point at the minimum permissible <br />disCance from the easterly Powder Magazine, which is anticipated as being not <br />greater than forty-one feet (41'). Any temporary Powder Magazines may exceed <br />the above-referenced separation distance. <br />F. DUST MITIGATION <br />1. The developers, to the extent reasonably feasible, shall prevent the <br />emanation of dust and other air borne particulates from the project site. <br />Without limiting the foregoing, the developers agree to have all loads of coal <br />covered with tarps or other acceptable methods to prevent the dissemination of <br />coal dust along truck routes. <br />0 <br />2 <br />
