STATE OF COLORADO qiC FiPRD D. L4M M. Govemm III III III III IIII III
DEPARTMENT OF NATURAL RESOURCES
D. Monte Pascoe, Enecutive Director
MINED LAND RECLAMATION
423 Centennial Building,1313 Sherman Street
Denver, Colorado 80203 Tel. (303) 839-3567
David C. Shelton
Director
T0: Tom G., Jim K.
FROM: Carol C r
RE: Coordination of the Blue Ribbon review with OSM
DATE: April 6, 1981
On April 6, 1981, Tom Gillis and I met with Dan Kimball of OSM to discuss
the coordination of this review. The following conclusions were reached:
1. MLRD will take the lead on all disciplines except for cultural
resources. We will use OSM's ACR, dated December 5, 1980, as the basis for
our sixty (60) day adequacy letter. Essentially all of these concerns are
still outstanding. MLRD will write.the TEA for all disciplines except cultural
resources.
2. Additional OSM comments on cultural resources, if any, will be delivered
to MLRD by April 20, 1981 for inclusion in the 60-day letter. However, most
of OSM's concerns are addressed in stipulations 3 and 4 of the March 2, 1981
minor modification approval.
3. MLRD will submit a draft of the 60-day adequacy review to OSM for
their comments on April 23, 1981. The letter will be sent to the Company on
April 27, 1981.
4. All concerns relative to coal resource recovery were resolved during the
review of the minor modification approved in March, 1981. Since the mine
plan has not been-changed, further OSM involvement in the review of this section
will not be necessary. The resource recovery section of the March 2; 1981
technical anlaysis remains applicable. If further comments are received from
USGS, these will be forwarded to MLRD, but none are expected.
5. MLRD will not review the application for socioeconomic impacts, and will
not include socioeconomics in the TEA. It is not expected that OSM will
identify any concerns, but if concerns do arise, MLRD will be informed.
6. Submission of a subsidence monitoring plan was required by stipulation
#5 of the March 2, 1981 minor modification approval. For this reason, when
the plan is submitted it will be reviewed by both MLRD and OSM, although MLRD
will have the lead in terms of permit approval.
7. Stipulation number 6 of the 14arch 2, 1981 minor modification approval has
been satisfied (payment of reclamation fces). Stipulation number 2 (production
rate) applies only to the minor modification, and OSM has no problem with the
production rate increase proposed in the present application.
/cjc
