DRAFT
XVII. Backfilling and Grading (2.05.3(6), 2.05.3(9), 2.05.9(2)(a), 2.05.4(2)(c),
4.09, 4.13, 4.19)
The mine bench material will provide the material necessary to backfill the mine
bench and haul road. Due to the steep slope nature and the tendency towards
instability a variance of the approximate original contour restoration requirements
of Rule 4.14.1(2)(a) is appropriate under the provisions of Rule 4.27.4. Blue
Ribbon Coal Company has committed to providing an appropriate geotechnicaZ analysis
to demonstrate compliance with Rule 4.27.4(1). All other provisions have been
satisfactorily addressed within the application. The description of the reclama-
tion plan including backfilling and _grading begins on page 108 of the permit
application. R plan view of the post-mining topography and correlated cross-
sections are presented on Exhibits F and B, respectively.
Underground development waste generated at the Blue Ribbon mine will be hauled to
the Red Canyon mine's approved waste disposal pile site. Both mines are currently
owned by lJestern Associates, Inc. If this corporate relationship were to be
modified in the future., the Blue Ribbon mine will be required to obtain approval
for an alternative waste disposal facility or to backstow the material within the
underground workings. The application is in compliance with the requirements of
this section of the regulations.
XVIII. Coal Processing Waste and Non-Coal Processing Waste (2.05.3(8), 2.05.4(2)(f),
4.10, 4.11)
The only coal processing done on the Blue Ribbon mine site is screening of coal
for size separation. No coal processing waste is produced during this process.
Therefore, the application is in compliance with the requirements of this section
of the regulations.
XXII. Sealing of Drilled Holes and Underground Openings (2.05.4(2)(8), 4.07)
(NO CHANGES NECESSARY)
XXZII. Subsidence (2.05.6(6), 4.
Shere are no renewable resource Zands or structures in the permit area. Therefore,
no further consideration is required by those sections of the permit regulations
which relate to subsidence control. The applicant has satisfied all statutory
obligations regarding subsidence.
XXI V. Special Categories of h]ininq (2.06, 4.22, 4.23, 4.26, 4.27, 4.28, 9.29)
The applicant has indicated an intention to request a variance from approximate
original contour restoration requirements for steep slope mining, pursuant to
Rule 2.06.5. The Division agrees that the portal bench area constitutes a steep
slope mining situation. However, the applicant has failed to properly demonstrate
compliance with the requirements of Rule 2.06.5(2). In order to demonstrate
compliance with these regulatory requirements, the Division imposes the following
stipulation.
