<br /> <br />-2- <br />Relationship to Areas Designated Unsuitable for Mining -Rule 2.03.7 <br />1. This <br />insurance policy should meet the minimum liability and injury <br />requirements of this section. <br />Identification of Other Licenses and Permits -Rule 2.03.10 <br />1. The applicant should note that all licenses and permits formerly issued <br />to Arness-McGriffin Coal Company must be revised and reissued to <br />Peerless Resources prior to the Division making an acceptable finding <br />in this instance. The applicant should additionally submit copies of <br />all resubmitted or new applications for those permits noted under this <br />section. <br />Land Use Information - Rule 2.04.3 <br />1. The Division disagrees with the applicant's contention that the <br />designation for the permit area should be "undeveloped land". Given <br />the cited uses of the land for mining, wildlife habitat, recreation, <br />and the noted use of grazing by the Division in the area; the Division <br />directs the applicant to contact all surface owners of lands within the <br />permit area and solicit their current uses and historic uses for the <br />permit area. Lacking this information, the Division will set the land <br />uses of the permit area at wildlife habitat, grazing land or range land. <br />2. The applicant has provided some information on historic mines located <br />in the Coal Gulch vicinity and permit area. The applicant needs to <br />provide the following information in addition; the type and description <br />of mining methods used for each mine and the uses of land preceding <br />mining if available. <br />
