C-84-067 <br />As requested, we have reviewed the above referenced application Eor a coal <br />mining operation in La Plata County approximately 5 miles west of Durango, <br />Colorado. The application states that no ground water is expected to be <br />encountered or used in the operation. Also, all surface flows will be <br />diverted around the affected area into a sedimentation pond and then released <br />to the streambed below the mine. We have no problems with the mining opera- <br />tion as long as the sedimentation pond can pass all the water it detains <br />within 48 hours. <br />Also, if Peerless Resources plans to use any water at the mine, they must show <br />a legal right to it.
