IF THE PERMITTEE ELECTS TO UTILIZE REFERENCE AREAS AS THE MEANS FOR <br />DETERMINING REVEGETATION SUCCESS: AT A MINIMUM ADEQUATE INFORMATION ON <br />VEGETATION COVER AND VEGETATION PRODUCTION WILL BE REQUIRED FOR EACH <br />REFERENCE AREA REQUIRED. THE PERMITTEE WILL FURTHER BE REQUIRED TO <br />DEMONSTRATE COMPARABILITY OF EACH REFERENCE AREA TO RESPECTIVE <br />COMMUNITIES. <br />In reviewing the revegetation plan many areas were not addressed sufficiently <br />to allow the Division to make a finding of compliance. For this reason the <br />following stipulation is required: <br />Stipulation 2 <br />THE PERMITTEE SHALL REVISE THE PERMIT WITHIN A 120 DAYS OF APPROVAL TO <br />REFLECT THE FOLLOWING REQUIREMENTS. IN THE CASE OF REQUIRED CHANGES, <br />BELOW, THE PERMITTEE MUST HAVE WRITTEN APPROVAL OF THE DIVISION PRIOR <br />TO THE STIPULATION BEING STATISFIED. <br />Revegetation Plan; <br />1. THE PERMITTEE NEEDS TO REVISE THE PROPOSED SEED MIXES TO REFLECT <br />SPECIES COMPOSITION ON-SITE AND GOALS OF THE POST-MINING LAND AREA. <br />2. THE PERMITTEE NEEDS TO PROPOSE MEASURES AND STANDARDS FOR <br />DETERMINATION OF REVEGETATION SUCCESS FOR; COVER, PRODUCTION, WOODY <br />PLANT DENSITY, AND DIVERSITY IN ACCORDANCE WITH RULE 4.15.7, or 4.15.10 <br />AS APPLICABLE. <br />Pursuant to Rule 2.07.6(2)(n) and based on available information, the Division <br />finds that the proposed activities would not affect the continued existence of <br />endangered plant species or result in destruction or adverse modification of <br />their critical habitats as determined under the Endangered Species Act of 1973. <br />With the acceptance and satisfaction of the above stipulations the proposed <br />operations is in compliance with the requirements of this section. <br />The permittee, during a meeting on October l7, 1984 committed to supplying the <br />Division with additional information regarding the production and rotation of <br />crops on the irrigated hayland areas to be disturbed. To date, the permittee <br />has not provided such information. This information will be required in <br />addition to information for the sagebrush vegetation community prior to permit <br />issuance. <br />/fw <br />Doc. No. 5701 <br />
