Page 3-2~ - Pubco Petroleum Company <br />d. Page 3-2-7 -Sage Creek Ranch <br />Please revise the application to provide the addresses for those entities. <br />4. Appendix 3-3 lists the ownership and control information for lands and minerals within <br />and adjacent to the Yoast Mine (cover page says Seneca II-W Mine). Not all of the <br />information required by Rule 2.3.6(1) has been provided. Information not provided <br />includes the type of document, date of execution, and the legal rights claimed. Please <br />provide additional information to comply with the cited rule. <br />5. Rule 2.03.6(2) requires additional information (written consent of surface owner or <br />documents of conveyance showing right to surface mine) where private mineral rights <br />have been severed from private surface ownership. This sepazation appears to be the <br />case for Tract 48. Please provide the additional information required by the cited rule, <br />or information to demonstrate that the rights have not been severed as u appazent. <br />6. Appendix 3-4, right of entry information, page 3-4-2 appears to contain an.error. Tract <br />2 rs hsted as the SWt/i SE'/. of Section 16. t would appeaz that the description should <br />have been the NW~/a SE~/a of Section.l6. Please verify thu description. <br />7. On Page 3~-3, the legal descriptions for File Number 429-005(5) do not appeaz to <br />include the description of Tract 11, yet Tract 11 is included m the list of tract <br />descriptions. The description of Tract 11 would be SWS/a SWt/a of Section 12, Township <br />5 North, Range 87 West, which is not in the descriptions listed. Please verify that the <br />legal description for Tract 11 has been included, or revise the page accordingly. <br />Tract 26 is also listed in this same File Number, and again it would appeaz that the legal <br />description has been omitted. Please verify and revise as necessary. <br />8. Page 3-4-4 notes that SCC does not have right-of-entrX for Tracts 53, 70, and 92. In <br />accordance with Rule 2.03.6(1), SCC must provide this information prior to issuance of <br />the permit application. Please submit the required information. <br />9. Appendix 3-5 lists Peabody Coal Company as the operator/permittee of the Seneca II <br />and II-W Mines. Please revise this information to indicate that SCC is the current <br />operator/permittee. <br />Tab 5 -Cultural Resources <br />10. As noted in Tab 5 pa a 3, the Bureau of Land Management BLM) had concerns <br />regarding the study conducted by Metcalf in March 1994 that were ater addressed in the <br />May 1994 study (Attachment 5~). According to SCC, the BLM is currently evaluating <br />this information to determine if all azchaeological concerns have been addressed.
