Some portions <br />of the application have not yet been reviewed, as noted below. For those portions whLCh were <br />reviewed, the Division has the following questions and comments. <br />Tab 3 - Adjudication File <br />1. The Applicant Violator System (AVS) was queried on December 19, 1994. The s stem <br />recommendation was to deny the permit application. On December 20, 1994 AVS~OSM <br />overturned the deny recommendation, recommending a conditional issue, ending <br />resolution of Kentucky State Violation No. 010667 (mine permit #8895005 Two <br />additional checks are required during this review process, one at the proposed decision <br />date and one prior to issuance of the permit. The Division will keep SCC apprised of <br />the results of these queries. If the issue is not resolved when the Division is ready to <br />issue the Yoast Mine permit, resolution of the matter will be a stipulation to the <br />Division's approval of the application. <br />2. Officers and directors for the controlling entities of Seneca Coal Company (Attachment <br />3-S pages 3 through 23) were compared with the officers and directors in the AVS. It <br />appears that there is some discrepancy in the information provided in the permit <br />applECation and that in the AVS. Please verify the information below and revise the <br />permiC application if necessary. <br />a. Peabody Coal Company <br />George S.
