27a. Table 13-1 and Table 1, Attachment 13-1 were revised to show
~ &b. curve numbers of: Rock outcrop - 98 and Paved Roads - 98.
28. The precipitation amounts were revised to include water
~~~ emanating from snow cover as snowmelt in a limited period of
time. Annual averages for the 10-, 25-, and 100-year storms
in the Yoast Mine vicinity are 1.7, 2.1, and 2.5,
respectively.
31. This comment addresses the retention of a portion of the Yoast
STID haul road as part of the postmining land use. This response
should also answer the following comments in your April 27
letter: 68 - Tab 19; 69 - Tab 20; 73 - Tab 21; 75 and 76 -
Tab 22; and 6 - Tab 25. The haul road is located on three
different surface owners; Jonathan Strong and Charles B.
Carroll, Hockett Farms, and Maneotis Sheep Company. Landowner
consent forms for the first two parties were submitted to the
Division on March 31, 1995. All of the pertinent information
is located in Appendix 22-2, Postmining Land Use comments and
• landowner consent forms. A postmining land use package was
sent certified mail on three separate occasions to the
Maneotis Sheep Company. Seneca Coal finally received the
receipt .for this package on March 23, 1995. A copy of this
receipt is included in Appendix 22-2.
In a phone conversation on May 15, 1995 between Mr. Tim
Harris, Land Manager for Peabody Western Coal Company and Mr.
John Maneotis, President of Maneotis Sheep Company, it was
stated that another set of consent forms would be mailed out
for his signature and they would be returned to Seneca Coal
Company. Mr. Maneotis agreed and said they would be returned
immediately after they are signed. An Easement Agreement was
made and entered into on January 15, 1992 by and between
Maneotis Sheep Company and Peabody Coal Company. Enclosed are
copies of Pages 1, 4, and 5 of this agreement. Please read
Section 12, Cooperation and Removal of Road on Page 4. In
summary, the Grantee (SCC) agrees to take reasonable efforts
to obtain the permission of the appropriate regulatory
authorities (CDMG) to leave and not reclaim and remove the
road which will be constructed, and the Grantor (Maneotis)
agrees to provide to those regulatory agencies (CDMG) such
requests and consents as Grantee (SCC) may reasonably request
in order to obtain such approval.
