The precipitation amounts were revised to include water <br />~~~ emanating from snow cover as snowmelt in a limited period of <br />time. Annual averages for the 10-, 25-, and 100-year storms <br />in the Yoast Mine vicinity are 1.7, 2.1, and 2.5, <br />respectively. <br />31. This comment addresses the retention of a portion of the Yoast <br />STID haul road as part of the postmining land use. This response <br />should also answer the following comments in your April 27 <br />letter: 68 - Tab 19; 69 - Tab 20; 73 - Tab 21; 75 and 76 - <br />Tab 22; and 6 - Tab 25. The haul road is located on three <br />different surface owners; Jonathan Strong and Charles B. <br />Carroll, Hockett Farms, and Maneotis Sheep Company. Landowner <br />consent forms for the first two parties were submitted to the <br />Division on March 31, 1995. All of the pertinent information <br />is located in Appendix 22-2, Postmining Land Use comments and <br />• landowner consent forms. A postmining land use package was <br />sent certified mail on three separate occasions to the <br />Maneotis Sheep Company. Seneca Coal finally received the <br />receipt .for this package on March 23, 1995. A copy of this <br />receipt is included in Appendix 22-2. <br />In a phone conversation on May 15, 1995 between Mr. Tim <br />Harris, Land Manager for Peabody Western Coal Company and Mr. <br />John Maneotis, President of Maneotis Sheep Company, it was <br />stated that another set of consent forms would be mailed out <br />for his signature and they would be returned to Seneca Coal <br />Company. Mr. Maneotis agreed and said they would be returned <br />immediately after they are signed. An Easement Agreement was <br />made and entered into on January 15, 1992 by and between <br />Maneotis Sheep Company and Peabody Coal Company. Enclosed are <br />copies of Pages 1, 4, and 5 of this agreement. Please read <br />Section 12, Cooperation and Removal of Road on Page 4. In <br />summary, the Grantee (SCC) agrees to take reasonable efforts <br />to obtain the permission of the appropriate regulatory <br />authorities (CDMG) to leave and not reclaim and remove the <br />road which will be constructed, and the Grantor (Maneotis) <br />agrees to provide to those regulatory agencies (CDMG) such <br />requests and consents as Grantee (SCC) may reasonably request <br />in order to obtain such approval. <br />• We will provide the Division with the signed consent form from <br />2 <br />
