Permit Nunber CO-0068, ( ) <br />Page 3 of 7 <br />• Sec. 9 The pernittee shall dispose of solids, sludge, filter backwash, or <br />pailutants removed in the course of treatment or control of waters <br />or emissions to the air in the manner required by the approved <br />Colorado State Program and the Federal Lands Program and which <br />prevents violation of any other applicable State or Federal law. <br />Sec. 10 <br />a. In accordance with any term of the permit as necessary to pre- <br />verrt significant, imminert environmental harm to the health and <br />safety of the public; and <br />b. Utilizing any methods specified as conditions of the permit by <br />the Colorado Mined Lands Reclamation Division (C:4LR0) and OS<~I <br />(if any) in approving alternative methods of compiiance with <br />the performance standards of the Act, the approved Colorado <br />State Program, and the Federal Lands Program. <br />Set. 11 fie permittee shall provide the names, addresses, and telephone <br />numbers of persons respansitrle far operations under the permit to <br />wham notices and orders are to be delivered. <br />Sec. 12 The permittee shall comply with the provisions of the Federal 'dater <br />Pollution Control Act (33 U.S.C. 1151-1175) and the Clean Air Act <br />(42 U.S.C. 7401 et seq.). <br />• Sec. 13 During mining aperatiorts if a previously unidentified cultural <br />resources site is discovered, the operator shall ensure that the <br />site is not disturbed and shall notify the regulatory authority. <br />The operator shall ensure that the resource(s) is properly - <br />evaluated according to the National Register of Historic Places <br />eligibility ~iter~ia (36 CFR 60.6). Shautd a resource be <br />deter-pined eligible for listing in the National Register of <br />Historic Places, the operator shall consult with and obtain the <br />approval of CMLRO and OSi4 concerning the development and <br />implementation of mitigation measures as appropriate. <br />Sec. 14 APPEALS - The lessee shall have the right to appeal (a) under 30 <br />CFR 787 from ac=ions ar decisions of any official of the Office of <br />Surface Mining; (b) under 43 CFR 3000.4 from an action or decision <br />of any official of the Bureau of Land Management; (c) under 30 CFR <br />2°0 from an action, order, or decision of any official of the U.S. <br />Geological Surrey; or (d) under applicable regulations from any <br />action ar decision of any other official of the Department of the <br />Interior arising in connection with this pernit. <br />Sec. 15 SPECIAL STIPULATIONS - In addition to observing the general obliga- <br />tions and standards of performance set out in the current regula- <br />tions, the pe.^..littee shall comply with and be bound by the rollow- <br />ing special stipulation (see attachment ~da.1).
