-3- <br /> <br /> <br />A chronology of events is enclosed denoting dates and descriptions of perti- <br />nent events regarding the Bear #3 Mine. Bear No. 3 mining plan was reviewed <br />by OSM under the Colorado State Program and the Federal Lands program (30 CFR <br />Chapter VII, Subchapter D). The Mineral Leasing Act portion of the MRP was <br />also reviewed for compliance with the applicable portions of 30 CFR Part 211 <br />(i.e., requirements and responsibilities of the Minerals Management Service <br />under the Mineral Leasing Act). The CMLRD and OSM developed the stipulations <br />which must be accepted by the applicant prior to issuance of a permit. These <br />stipulations will be made an integral part of the Bear #3 mining and reclama- <br />tion permit. <br />The U.S. Geological Survey (now Mineral Management Service) provided written <br />concurrence with the proposed action on December 15, 1981 and March 24, 1982. <br />The Bureau of Land Management provided written concurrence on April 4, 1982. <br />The U.S. Fish and Wildlife Service was consulted regarding threatened and <br />endangered species and provided opinions in their April 9, 1982 letter. The <br />State Historic Preservation Officer concurred with OSM's proposed compliance <br />with 36 CFR Part 80 on April 16, 1982. A copy of each letter of concurrence <br />is enclosed. <br />The TEA, other documents prepared by CMLRD, the company's application, and <br />correspondence developed during the completeness review and technical and en- <br />vironmental analysis are part of the mining and reclamation plan file. The <br />State Notice of Decision in coordination with OSM was published in the news- <br />paper on May 17, 1982. <br />Based on this review, and as reflected in the attached recommendation package, <br />I recommend that you find that Bear Coal Company's permit application affir- <br />matively demonstrates that the conditions outlined in the Findings have been <br />complied with and that you recommend approval for the Bear #1,#2 and #3 Mine <br />mining and reclamation plan and issuance of a five year permit. <br /> <br />
