Mr. Tom Wainwright - 2 - June 27, 1985 <br />- If cropland is to be taken out of production, Peabody needs to <br />address what percentage of each individual owners land will be <br />effected. <br />- When overlaying maps 6-lA and 4-1 it is apparent that the <br />tie-across haul road will cross alluvium, boulder deposits and <br />terraces. This seems to contradict statements in the text which <br />indicate that the road will not cross alluvial deposits. <br />6. The application states that the Wolf Creek/Wadge interburden is found <br />to be under water table conditions. Both the Wadge and Wolf Creek <br />exhibit confined conditions, why doesn't the interburden? <br />Legal, Financial, Compliance <br />1. Rule 2.03.6(2) requires that copies of documents verifying surface <br />owner consent be submitted in cases where the surface estate is severed <br />from the mineral estate. These should be submitted. <br />2. Exhibit 3-2 lists George Dolezal, Jr. as a coal owner yet his name is <br />not listed in Section 2.03.4(1)(b). Please clarify. <br />3. In Section 2.03.10, Identification of other licenses and Permits, there <br />is no mention of an air emissions permit. Has such a permit been <br />applied for? <br />These questions need to be addressed before the Division can complete the <br />Findings of Compliance for Seneca fI-W. <br />As we also discussed, Peabody needs to address questions raised by the Bureau <br />of Land Management, Office of Surface Mining and U.S. Fish and Wildlife <br />Service concerning this permit application. <br />If you have any questions, please contact me. <br />Sincerely, <br />Anne C.
