<br />activities on the Lands for the purpose of: (1) <br />surveyiag; (2) conducting exploration activities; (3) <br />construction of a pad or pond for one exploration <br />borehole and drilling one exploration borehole; (4) <br />utilize any existing road into the drill sites and <br />construction of an exploration road(s) from the <br />existing road into the drill site; and (5) general <br />reclamation of drill/bore hole site and other <br />disturbed areas. <br />b. Cyprus at all times will fully and promptly comply <br />with all applicable laws, rules and regulations of <br />any governmental authority which apply to its use of <br />the Lands for the hereinabove stated purposes; <br />c. Cyprus is hereby given the right of ingress and <br />egress for itself, its employees, agents, licensees, <br />contractors, subcontractors, invitees, successors and <br />assigns to and from the Lands on or across the <br />existing ranch or farm roads of Surface Owners <br />connecting said Lands to the nearest public road or <br />roads including, but not limited to, the right to <br />transport on, over, across, under and through the <br />Lands and such roads supplies, materials and <br />equipment necessary to support Cyprus' activities on <br />the Lands; <br />d. Cyprus shall at all times use Surface Owners' roads <br />which are located on the Lands in a reasonable and <br />prudent manner so as to prevent damage to such roads <br />and any improvements which may be located thereon or <br />which may be adjacent thereto. Cyprus shall use its <br />best efforts to limit vehicular traffic to the <br />shortest practicable routes and to utilize existing <br />roads or previously utilized routes as often as is <br />reasonably practicable in order to minimize surface <br />disturbance. Cyprus shall ensure that the speed of <br />all vehicles shall be kept to a reasonable rate and <br />it shall ensure reasonable further precautions tc <br />avoid any damage, other than normal wear and tear and <br />damage due to the elements and fire, to gates, <br />bridges, roads, culverts, cattle guards, fences, <br />dams, dikes or other facilities. All damage in excess <br />of ordinary wear and tear, damage due to the elements <br />and fire excepted, shall be reported to Surface <br />z <br />
