Enclosed with this letter you will find two original executed copies of
the above referenced permit. Please have them countersigned, and one
copy returned to me for our records.
As you know from my letter of December 12, 1984, and our discussions of
January 25, 1985, both Dorchester and its prospective successors have
serious reservations concerning the propriety of paragraph C-4 on pages 4
and 5 of the permit document. You should be aware that our present
intention is to sign the enclosed permit documents and then to challenge
the existence and terms of paragraph C-4 at a later Board meeting. In
addition, we intend to reconvene discussion with your staff and perhaps the
Board concerning the apparently inconsistent policy underlying Stipulation
No. 1.
I would like to take this opportunity to thank you and your staff for your
cooperation and assistance in completing the re-permitting process for the
Dorchester #1 Mine. In particular, we commend the fine efforts of Bob Liddle.
His knowledgeable and fair approach to settling the issues was an essential
ingredient to the resolution of the final permit document. We look forward
to continuing the excellent relationship that has developed with your agency
over Bob's tenure overseeing our operation.
