.o <br />_22_ <br />Pursuant to Rule 2.07.6(2)(n), the Division finds that the activities will not <br />affect the continued existence of threatened or endangered animal species or result <br />in the destruction or adverse modification of their critical habitats. <br />With the acceptance of this stipulation, the operation is in compliance with the <br />requirements of this section. <br />XIV. Prime Farmland - Rules 2.09.12, 2.06.6 and 4.25 <br />The Division has reviewed the material submitted by the applicant in Exhibit IV-13 <br />of the permit application. <br />The Soil Conservation Service has reviewed the soils occurring within the proposed <br />permit area and has determined that there are no soils which qualify as prime <br />farmland. Based on this information and pursuant to Rule 2.07,6(2)(k), the Division <br />renders a negative determination for the presence of prime farmland within the <br />proposed permit area of the Trinidad Basin Mine. <br />The operation is in comoliance with the requirements of this section. <br />XV. Operations Descriotion - Rules 2.05.2, 2.05.3(1), 2.05.3(2) and 4.01 <br />The general description of the mining operations and facilities have been reviewed <br />by the Division for compliance. The general description of mine operations can be <br />found in Sections 5.1 - 5,3 (pages V-1 - V-20) of the permit application. <br />The Trinidad Basin Mine intends to contour strip coal at an anticipated rate of <br />240,000 tons per year. An anticipated 1.2 million tans will be mined during this <br />permit term. The Life of the mine is expected to be five years and end after this <br />permit term will expire. The total affected area is anticipated to be 250 acres. <br />Two coal seams will be removed in separate contour strip and angering operations <br />in three pits. The coal seams dip 2° - 5° west. The Cass seam ranges from 3.5 - <br />4.5 feet thick in the permit area, while the Del Agua seam ranges from 4.5 - 6.0 <br />feet. <br />The operation is in compliance with the requirements of this section. <br />XVZ. Explosives - Rules 2,05.6 (a) and 4,08 <br />The Division has reviewed the sections oi` the permit application regarding the <br />blasting operations plan and performance standards (Section 7, 7, pages VII-10 to <br />VIZ-Z1, and Exhibit V-2) and has determined that the operation is in compliance <br />with the requirements of this section. <br />XVII. Backfillina and Grading - Rules 2.05.3!3). 2.05.3(9), 2.05.4(2)(a <br />4.I <br />The Division has reviewed the permit application for compliance with the requirements <br />of this section. Material can be found in Sections 5.3 (pages V-lI - V-16), 5.4 <br />(pages V-21 - v-26), 7.8 (page VII-12), 7.I0 (page VII-14), 7.1I (page VII-15) and <br />responses dated February 2, 1982 and June 18, 1982. <br />
