This letter constitutes the sixty day notification of preliminary
findings as required in 2.07.4(1) of the Colorado Rules and Regulations.
The preliminary nature of the enclosed comments must be stressed at this
point. Additional information may be required from H-G Coal Company as the
review continues.
One particular concern raised relates to
to the loadout facility. It is required
rules and regulations as the mine. The
in dealing with the loadout with respect
backfilling and grading and reclamation.
this information.
an outstanding omission with respect
that it be subject to the same
jpplication is particularly deficient
to pre-mining environment (Rule 2),
Please provide the Division with
The basic organization of the permit application has made the review
difficult. For example, the lack of appropriate pagination and the lack of
appropriate cross-referencing makes it difficult to understand Borne of
the information in the application. These same factors may create further
problems in the ensuing period of review. It will be necessary to correct
this problem before final approval by the Division.
The Division's decision to approve, deny or modify the permit application
or to continue the review for another sixty days after the one hundred twenty
(120) day review period expires depends largely upon how rapidly H-G Coal
Company responds to this letter. It is unlikely that the Division will be
able to have sufficient time to complete the review by the one hundred
twentieth day if your responses are received after May 11, 1981. Please
submit information in a form consistent with the application so that pages
can be replaced, etc. I recommend that once you have examined our comments
we have a meeting to discuss the issues.
(cont'd)
