_ _-. <br />NOTICE OF PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulation an application for a permit to conduct coal mining and reclamation <br />operations submitted by Grand Mesa Coal Company for the Red Canyon Mines, an <br />underground coal operation in Delta County. <br />Operations being permitted include the existing Red Canyon No. 1 Mine, the <br />proposed Red Canyon No. 2 Mine, and existing rail load-out facility. <br />The mine portals are located approximately 3 1/2 miles northwest of <br />Cedaredge, Colorado. The load-out is located immediately to the north of the <br />Delta, Colorado city limits, at the site of the farmer Holly Sugar Processing <br />Plant. <br />The No. 2 Mine will produce coal from a seam located 130 feet <br />stratigraphically below the seam currently being mined. Coal extraction will <br />be limited to 50% beneath structures, and 55% in other portions if the permit <br />area in order to prevent subsidence related material damage. <br />Surface facilities will be located immediately adjacent to the existing <br />facilities and will result in a combined surface disturbance of approximately <br />41 acres. Maximum projected annual production for the mines is 560,000 tons. <br />All of the coal to be mined via the No. 1 portals is privately owned, while <br />approximately 4% of the coal to be mined via the No 2 portals is from Federal <br />lease D-036906. The permit area at the mines encompasses 610 acres in <br />portions of Sections 2, 11, 12, 13, and 14, of T13S, R95W of the 6th P.M. The <br />permit area at the load-out is located in the NWl/4 NWl/4 Sec. 13, T15S, R96W <br />of the 6th P.M. Portions of the permit area overlying the mine workings are <br />owned by numberous private landowners. The facilities area at the mine and <br />the load-out permit area are owned by Grand Mesa Properties Company and <br />subleased to Grand Mesa Coal Company. <br />The proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-TOi et seq., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision and the findings of compliance, including <br />stipulations are available for public review or for a copy fee can be obtained <br />from the Colorado Mined Land Reclamation Division, 423 Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203. Any person with an interest that <br />may be adversely affected by the proposed decision may request a hearing <br />before the Colorado Mined Land Reclamation Board on the proposed decision. <br />Such requests must be made within thirty (30) days of the initial publication <br />of this notice, must be in writing, and must state the reasonable specificity <br />the reasons for the request and the objections to the proposed decision. <br />/ph <br />Doc.
