Cattany <br />Division Director <br />Natural Resource TrustEe <br />Thank you for seeking a determination as to the need for Mined Land Reclamation Boazd Per[nit. <br />We have reviewed the information in your Apri15, 2005 letter. It is the Division's opinion, <br />based on that information, that a reclamation permit from the Mined Land Reclamation Board <br />will not be needed. It appears that your project meets the conditions necessary to allow an <br />exemption. Specifically, exemption #1 applies where the material will not leave the landowners <br />property and the material is used to maintain ranching and other agricultural operations. <br />The Board has requested that the Division make determinations as to the need for a Mined Land <br />Reclamation Boazd Permit. If you disagree with the Office determination, you may request a <br />Mined Land Reclamation Board hearing. Please provide the Division a written request if you <br />would like the Mined Land Reclamation Board to consider your request for an exemption.
