III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash and Jim Stark of the <br />Colorado DMG. Gary Harding represented the operator. According to the <br />operator, the area has received heavy rains the last few weeks. The mine site <br />was dry during the inspection. <br />Roads <br />The main haul road and the haul road to the gob pile were in excellent condition. <br />No problems with the guard rail were noted. The access road from the portal <br />bench to the vent fan bench was in good condition. <br />Hvdrologv <br />The operator is attempting to dry out pond C in preparation for cleaning. The <br />operator is using the excess capacity of pond D to handle the water, although <br />pond D had very little water in it at the time of the inspection. Pond 8 had water <br />to a level just above the primary spillway. The gated valve was closed and there <br />was no discharge. <br />No problems were noted with any of the culverts, ditches and SAES. The seep <br />above the portals was wet but not flowing. <br />Facilities <br />Mine personnel have been moved into the new bathhouse. The new vent fan is <br />operational. Muck from the construction of the shaft has been moved to the gob <br />pile. The operator has removed all vegetation within 100 feet of the vent fan, per <br />MSHA requirements. No problems were observed with any of the facilities. No <br />problems with fugitive dust were observed. <br />Gob Pile <br />The operator has graded the top of the gob pile so that there is positive drainage <br />across the entire pile surface. <br />C:\ms97\bowie2\insp0899 <br />
