III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This partial inspection of the La Plata Coal Mine was conducted by DMG staff from the Durango Field
Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The inspection
occurred in response to a request from Ms. Karen Hunzeker, landowner for portions of the permit area
located on the south side of County Road 120, for an on-site meeting with DMG.
The permit was revoked in 1989. The surety, Rocky Mountain Bank & Trust, became the successor
operator for the purposes of completing reclamation. Rocky Mountain Bank & Trust has attained
Phase I and II bond reduction and has requested Phase III release for completion of reclamation. The
inspection for the Phase III bond release occurred on June 4, 2004. Follow-up inspection occurred on
July 8, 2004.
This inspection focused on reclamation of lands owned by Ms. Hunzeker. Current land use for lands
located within the permit boundary and owned by Ms. Hunzeker was irrigated pastureland. Irrigation
water was flowing in the Hay Gulch ditch, through Ms. Hunzeker's property. Irrigation activity was not
active during the time of this inspection. Evidence of livestock grazing was abundant.
Ms. Hunzeker indicated no objection to the Phase III release request. Ms. Hunzeker requested a CD
copy of the permit file and paid the inspector $5.00 cash for the file copy. Receipt No. 0808, for the
$5.00 payment, is attached with this report.
RECEIPT DATE ~ '" Nom- 0808
r n uw\ze e~
RECEIVED FROM
p o, 30~
ADDRES f% .nrni/l N~ ~77oZ0-$ 5=~---
FOR ~ ~ oT ~~ ~@ C'
CASH
Q CHECK
(J MONEY
ORDER
