III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />easement is not conveyed, the operator will complete the <br />backfillinq next year along with several other small items that <br />remain to be reclaimed including some concrete removal and <br />regrading on the west side of the creek. <br />After next years reclamation work is completed, the area will be <br />reseeded with the permanent seed mix. The operator did seed and <br />mulch with a temporary mix this year. The mulch consisted of oat <br />hay which contained a number of mature seeds, many of which have <br />germinated to provide a nice cover crop of oats. Prior to seeding <br />the final mix the operator will analyze the seed bed material for <br />plant nutrient deficiencies and apply fertilizer as needed. This <br />will be an important step as no topsoil was salvaged from this site <br />for use during reclamation. <br />The upper hubbard site was stable and the pond was dry. This area <br />is also under consideration for a public use area with the final <br />details yet to be completed. The public agency in charge of this <br />area is the U.S. Forest Service and the right-of-way easement <br />details are still being worked out. Upon completion of this <br />easement, the reclamation plan will be finalized and should remain <br />mostly as it is. <br />The Bear Canyon site was also inspected and the work to relieve <br />potential slump failures near the toe of the fill where it comes <br />into contact with the creek has been completed and looks good. <br />This area has also had a temporary seed mix applied to the <br />disturbed areas. The backfill and grading portion of the <br />reclamation plan for this area was revised earlier this year and <br />the reclamation was scheduled to be completed this year. However, <br />there was an objection to the approved plan which has not been <br />completely resolved at this time. Therefore, the final reclamation <br />was rescheduled for 1996 pending resolution of the revision to the <br />plan. The operator did complete various portions of the plan that <br />were not the subject of the revision including initial backfill of <br />the portal and removal and burial of the concrete foundations that <br />were on the bench. In addition, the bench was regraded to improve <br />the surface water control at this site. <br />The site inspection was completed at the main facilities area where <br />pond A contained a very small amount of water and pond B was <br />holding a fair amount of water below the discharge level. The <br />drainage control system associated with pond B was inspected and is <br />in good condition. <br />
