(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_r9RV_nde <br />INSPECTION DATE: ~-9-n~ INSPECTOROS INITIALS: ~1C- <br />OBSERVATIONS <br />The Division conducted a follow up monitoring inspection of the site, while in the area on 7-9-03. The site is a <br />very small in stream sand and gravel operation that has been in active for many years due to the operator not <br />having the appropriate water rights to wet mine the area. When the site was approved for wet mining in 7989, <br />operator thought they would be able to obtain the appropriate water rights. Since the sffe was permitted as part <br />of a Board Action, it was assumed at that time the water rights issues will be resolved. When the site was <br />inspected with Mr Harold Clare present on 3-10-03, Mr. Clare had agreed to submit a TR to change the mining <br />plan from WET TO DRY, or try to obtain the required permit from the State Engineer's OFFICE. To date the Division <br />has not received the Technical Revision application or the required permit from the State Engineer's Office. <br />Since the operator has already obtained a permff hom the Army Corps, The TR changing the mining plan from <br />wet to dry, should allow the operator to commence mining as narrated in the inspection report dated 3-10-03. <br />The Division needs a response in writing as to which option the operator is pursuing or the might be required to <br />commence with the reclamation of the site. The existing warranty is adequate fo complete the current <br />disturbance at this time.
