~ • <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1994-OF,0 <br />INSPECTION DATE: t~/8/nn INSPECTORS INITIALS: JCS <br />OBSERVATIONS <br />This inspection was conducted to check compliance of the operation with the requirements of the Act, <br />Rules and the conditions of the permit. The operator, Las Animas County, was represented during the <br />inspection by Fred Jones. The site was inactive at the time of the inspection. <br />The ID sign was in order and the permit area boundaries adequately marked. <br />Access to the permit area is by means of an unimproved ranch road. The areas of extraction are small and <br />the total mining related disturbance at the site is quite limited. Most of the disturbance appeared, to this <br />inspector, to actually pre-date issuance of the permit. According to the County representative, the County <br />has not taken any material from the site for its use; the pit, as it currently appears, is the result of actions by <br />the landowner, some of which reportedly took place quite recently. The County, however, is reminded that, <br />since the County is now the permit holder for the site, the Division must hold the County responsible for <br />reclamation of all disturbance in the permit area occurring aker the permit was issued, regardless of who <br />may actually leave generated that disturbance. This reclamation obligation will extend to the pre-permit <br />disturbance if that is re-disturbed by the County, the landowner, or any other party the County allows to <br />take material from the pit. It is, therefore, suggested that the County document, in some effective way, e.g. <br />with dated pictures, the extent and nature of the current mining related disturbance at the site if the County <br />does not intend to re-disturb these areas and does not want to be held responsible for their reclamation. <br />The margins of the two small, relatively shallow, extraction areas are largely vertical, and there are several <br />small stockpiles of material along some of these margins as well as nearby. It is not certain if these <br />stockpiles contain pit run, overburden, or topsoil. Since the mining related disturbance at the site appears to <br />essentially pre-date the issuance of the permit, the County will not be held responsible for any sloping of <br />the current pit margins or lack of topsoil adequate to reclaim the old disturbance, so long as these old <br />disturbed areas are not re-disturbed and their current extent and nature are well and timely documented. <br />I & E Contact Address <br />NAME: Mr. Robert A.
