The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the (acts or evidence supporting the enforcement action. <br />Phase I Bond Release for the Loadout (cont.) <br />Drainage Control (cont.) -The bean(s) around the reclaimed area should keep undisturbed <br />runoff from reaching the disturbed area and disturbed runoff from reaching the undisturbed <br />areas. It appears that the Loadout has been graded so that all of the disturbed runoff will <br />end up in the sediment pond. There was water in the irrigation ditch on the Southwest side <br />of the loadout (going into the sediment pond). There were no erosion problems noted at the <br />reclaimed Loadout. The drainage and sediment controls meet the requirements of Rule <br />3.03.1(2)(a) for Phase I Bond Release. <br />Conclusion <br />Based on the bond release application, related maps and drawings and the field inspection, <br />the Division believes that the Operator has met all of the requirements of Rules 3.03.1(2)(a), <br />3.03.1(2)(b) and 3.03.1(3)(b) for the requested bond release (with the exception of the <br />exclusions in Pit 1). The Division will do a reclamation cost estimate on all areas that are not <br />being released from liability (based on this request) to ensure that adequate bond is in place <br />to complete all remaining reclamation (Rule 3.03.1(3)(d)). Further, the Division will, in <br />accordance to Rule 3.03.2(5)(a), issue a proposed decision regarding the bond release <br />request within sixty (60) days. <br />
