Compliance with Colorado .i ur_`ace Coal aininy Reclamation Act <br />CRS 2973, as amender 34-33-SOZ, et. sea., <br />a:.d the <br />Rules and Regular one issued Pursuant ~ *he Act <br />This includes a listing of the particular previsions of the requlatorj program which were <br />examined during the course of t_`ti.s inspection, aid identifies enforcement actioris taken <br />during the inspection for failure to comply with the Rules and ReguZac:ons, Ghe Act and <br />the permit. <br />4.02 Suns and ~7arkers <br />The mine ID sign is in compliance. The topsoil marker on tine stockpile behind the <br />lower coal stockpile needs to be repaired. <br />4.03 Roads <br />Slides of rock and soil had narro:aed the mine road in several places. This material <br />should be cleared away and disposed of r•rith other refuse. <br />The road that leads up to the old fan area has been completely blocked by slides. <br />Proper actions regarding clean up or closing of this road should be discussed •~eith <br />the Division. <br />4.05 llydrologic Balance <br />The road ditch that leads around the switchback had been cleaned out. <br />The inlet end of culvert ]J1 was beginning to fill with sediment. Also the d~tc.h <br />that leads from the outlet of this culvert to Pond +r2 had been filled in b >lide <br />material. This should be cleaned out. <br />The sewer line that leads off the bench has been repaired. 'I'bis line ends ar, the <br />ditch at the base of the bench. Liquid effluent is discharged about half c:'a>• up <br />the old ditch and tric};1 es down the ditch, into pond Jt2. <br />lYater is being pumped from the large pond next to Hubbard Creek up to the mine <br />bench. <br />The inlet end of the ]over coal stockpile culvert could not he seen under n large <br />rock. The operator should make sure that the inlet is open. <br />The straw bale sediment fence along a shurt portion of Ilubbnrd Creek is Falling <br />apart or is being eaten by deer. This fence should be reco~rstructed as it was <br />or replaced with another device. <br />A good strong berm was noted at the southern portion of the mine bench. On the <br />northern portions the coal stockpile grades into the bench cutslope. Any runoff <br />drains into sediment pond k2 at the foot of the bench. <br />4.06 To soil. <br />Seeding and mulching of the topsoil stocl.p:ile below the mini bench should he con- <br />ducted this spring in order to attempt to stabilize this pile. <br />4.09 Disposal of Excess Spoil and Underground llevelopmcnt 4Jastc <br />A small pile of what appeared to be high ash coal was piled nt. fhc hack of t.h^. <br />bench and at the south end of the lower ~'nal stochpile, <br /> <br />
