III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observattons made <br />during the inspection. Comments also describe any enforcement actions-taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. The operator was <br />represented by Jim Kiger for the field inspection and records check. <br />Roads <br />The paved main haul road and east entrance road were in good condition. The guard rail was up along <br />the main road and the east gate was open. The road along the railroad tracks was dry and passable. <br />Signs and Markers <br />Mine ID signs were up at the main entrance, the east side entrance and near the east pond, by the <br />tracks. Perimeter markers were up around the loadout site. <br />Hvdroloav <br />The culverts at the loadout were clear. Collection and diversion ditches had sufficient capacity. The <br />operator has installed new silt fence along the railroad track small area exemption. In the same area, <br />straw bales were in place. <br />There was a little standing water in the east pond. The pond inslopes were stable, as was the well <br />vegetated embankment. The primary spillway gated valve was closed and the riprap in the emergency <br />spillway was intact. The west dugout pond was dry. The private irrigation ditch along the west side of <br />the loadout property was functioning properly. <br />To soil <br />The vegetative cover on the east topsoil stockpile was moderate. The collection and diversion ditches <br />were functional and the topsoil stockpile sign was up. On the west topsoil stockpile, the south-facing <br />slope was greening up while there was good cover on the other sides ofthe pile. The collection and <br />diversion ditch/berm was functional. The topsoiul sign was up on this stockpile as well. <br />Facilities <br />There were no compliance problems at any of the facilities. There were no leaks at the fuel facility. <br />There was only a small amount of stockpiled coal on site. The fines are being screened out before the <br />coal is hauled to the loadout. There were no problems with fugitive dust, although no coal haul trucks <br />were unloading and no railcars were being loaded during the inspection. <br />Records <br />The records were in compliance, as recorded on the attached records checklist <br />c:/word/terror/insp0405 <br />
