Box 435 <br />Durango, CO 81302 <br />All persons wishing to give testimony were sworn. <br />Secs. 3 and 15, T6N, R95W, 6th P.M., Moffat County, 9 acres; 110(2) <br />surface limestor~e quarry. Consideration of a possible notice of <br />violation, cease and desist order, corrective actions and civil <br />penalties for mining and stockpiling outside the permit boundary. <br />Staff distributed EXHIBIT A, a package of information including a <br />presentation form, a synopsis of events and a February 10, 1991 letter <br />to the. Board from the operator, Mr. Charles Butler. Staff also <br />presented and referenced EXHIBIT B, a location map. <br />Staff said that this permit (the Juniper Mountain Limestone Quarry) was <br />approved in August of 1982; on February 16, 1990 a technical revision <br />to add 2 quarry sites was approved. On November 15, 1991 Staff met <br />briefly with the operator and discussed the forms necessary to convert <br />this 110 operation to a 112 operation. Those forms were subsequently <br />mailed to the operator. <br />Staff said that in anticipation of receiving the conversion application <br />( from the operator, the Division conducted a pre-operation inspection at <br />' the site accompanied by Mr. Darryl Steele, who mined the site for the <br />company. After leaving the site, Staff realized that permit boundaries <br />had been misinterpreted and that the operator had been mining outside <br />of those boundaries. At that time, the Division cited the operator for <br />a possible violation for mining outside the permit boundaries. <br />When the Division met with the operator on February 5, 1992 to review <br />the conversion application, the operator volunteered information that <br />he had mined outside the permit boundary. The operator stated that he <br />had become aware of the infraction in September of 1991, and ceased <br />mining on December 14, 1991. <br />On February 13, 1992 the Division received a letter from the operator <br />in which his account of events at the mine were listed; a map on which <br />the area of current disturbance was included. In that letter, the <br />operator stated that the BLM was aware of the problem in July of 1991, <br />however, the BLM did not contact the Division. <br />On February 19, 1992 the operator agreed to mark the permit boundaries <br />on the ground. On February 24, 1992 the operator informed Staff that <br />the conversion application had been mailed to the Division. Staff <br />showed slides, EXHIBIT C, and discussed the disturbances at the site. <br />Staff recommended that the Board, as a corrective action, order the <br />operator to submit an amendment or permit conversion (from a 110 to a <br />112) which includes the added area of disturbance by March 25, 1992.
